Terms and Conditions

1. Scope

These Terms and Conditions (T&Cs) apply to all contracts for services provided by VERID, operated by Markus Angerer, Schillerstraße 2, 8280 Fürstenfeld, Österreich (hereinafter “VERID”), that are concluded through the website verid.at, and to the use of the website. Any conflicting terms put forward by customers do not become part of the contract unless VERID expressly agrees to them.

2. Description of services

From a guided capture or an uploaded photo, VERID produces biometric ID and passport photos: analysis, quality checking, fitting into the chosen format and digital provision for download. Printed products may be offered as an option; their availability, properties and prices follow from the description in the ordering process. Details are set out in the Delivery terms.

The customer is responsible for the source material, the subject and the necessary image rights; VERID is responsible for the agreed technical processing. Whether background removal is possible depends on the source material; there is no entitlement to a particular aesthetic or to a pixel-identical reproduction of reality, including for Business Portrait and VERID AI. The files made available are to be saved by the customer; collection is possible for 30 days and 5 times per item. Statutory warranty rights remain unaffected by this.

3. Formation of contract

The presentation of services on the website is not a binding offer but an invitation to place an order. The contract comes into being with the customer's payable order and VERID's acceptance of it, at the latest when the result is made available. The contract is concluded in German. The individual steps leading to an order, and the means of reviewing and correcting entries before the order is placed, follow from the ordering process; the order confirmation is sent by email, and these Terms and Conditions remain available on the website and can be saved.

4. Prices and payment

All prices are shown during the ordering process as final prices in euros; the tax information relevant for invoicing is stated on the relevant invoice. Any shipping costs for printed products are shown separately before the order is placed.

Payment is made through the payment service provider Stripe using the payment methods shown during the ordering process; the price falls due when the order is placed, and the service is performed only after payment has been confirmed. Stripe processes the payment data as a processor within the meaning of the DSGVO (GDPR); VERID never receives full card details. Further information is set out in the privacy policy.

If a payment fails, no entitlement to the service arises; the order can be attempted again with a different payment method, and processing steps already begun are not made available in that case. Refunds are made free of charge using the original means of payment, unless expressly agreed otherwise; the conditions follow from the statutory right of withdrawal and from statutory warranty rights.

5. No entitlement to official acceptance

VERID checks photos technically against open image quality standards and the stored official format requirements; there is no guarantee of acceptance by a particular authority, as that decision rests solely with it. If a technically checked photo is nonetheless rejected, VERID will seek to put matters right within the scope of the statutory warranty.

6. Permitted use

VERID may be used only with the customer's own photos, or with photos for which valid consent from the person depicted has been given. The following, in particular, are not permitted:

1. uploading photos of other people without their consent,
2. any abusive use, such as automated bulk access or circumventing technical protection measures,
3. any deception about the customer's own identity,
4. any manipulation of photos or results with the aim of forging documents or deceiving public authorities.

VERID results are intended solely for lawful purposes. Where there is reasonable suspicion of a breach, VERID may block or restrict access; contact hello@verid.at. Statutory rights remain unaffected.

Children under 14 may use the service only together with a person holding parental authority, who also places the order.

7. Statutory warranty and liability

Statutory warranty rights apply. Towards consumers, these rights are neither excluded nor limited. VERID is liable under the statutory provisions for intent and gross negligence, and without limitation for personal injury. For slight negligence, other than for personal injury, VERID is liable only where material contractual obligations are breached; mandatory statutory liability rules (for example under the Produkthaftungsgesetz, the Austrian product liability act) remain unaffected.

8. Copyright and rights of use

Customers retain all rights in their own image. VERID receives only the authority required to perform the service, limited in time to that purpose, to process the images submitted (analysis, fitting, checking, production and provision of the results ordered). Any transfer or assignment of personality rights, image rights or rights of use going beyond that expressly does not take place. Any use of images to improve or train products, or for marketing and references, takes place solely on the basis of separate, voluntary consent that can be revoked at any time, never through these Terms and Conditions.

9. Support

Support is available through the support dialogue on the website and by email at hello@verid.at, and covers technical help with the product, but not legal advice, tax advice or binding information about the requirements of individual public authorities.

Personal data from support enquiries are processed in accordance with the privacy policy; statutory warranty rights are unaffected by support.

10. Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.

11. Right of withdrawal

Consumers have a statutory right of withdrawal (right of cancellation). Details, time limits and the model withdrawal form are set out on the page Withdrawal; further particulars for digital content and printed products are set out in the Delivery terms.

There is no right of withdrawal for printed passport photos, being custom-made items (§ 18(1)(3) FAGG); for digital content, the right lapses early as soon as VERID, with the customer's express agreement and acknowledgement, begins providing the content before the withdrawal period expires and has supplied the confirmation of contract (§ 18(1)(11) FAGG).
